WASHINGTON -- The Supreme Court is taking up a First Amendment clash over the governments refusal to register offensive trademarks, a case that could affect the Washington Redskins in their legal fight over the team name. The justices agreed Thursday to hear a dispute involving an Asian-American rock band called the Slants, but they did not act on a separate request to hear the higher-profile Redskins case at the same time.Still, a high court ruling in favor of the Slants could bolster the football teams legal fight. Both groups argue that it is unconstitutional for the government to reject trademark rights for offensive speech. The trademark dispute is one of eight new cases the Supreme Court added to its calendar for the term that starts Monday. The court continues to operate with only with eight justices since Antonin Scalia died in February. His successor appears unlikely to be confirmed until sometime after the election. In the Slants case, front man Simon Tam tried to trademark the name in 2011, but the U.S. Patent and Trademark Office denied the request on the ground that it disparages people of Asian descent. He sued, and a federal appeals court ruled last year that the law barring offensive trademarks violates free speech rights. The Redskins hoped to piggyback on the bands case, asking the Supreme Court to consider both disputes at the same time. The trademark office canceled the teams trademarks last year after finding they are disparaging to Native Americans. But the teams appeal has not even been heard yet by a federal appeals court in Richmond, Virginia. In an unusual request, the team asked the Supreme Court to intervene before the lower court acts. The high court almost never grants such requests.Tam says his goal in choosing the name was to transform a derisive term about the shape of Asian eyes into a statement of ethnic and cultural pride. The Redskins have similarly claimed their name honors American Indians, but the team has faced years of legal challenges from Indian groups that say the name is racist. The team has also come under intense public pressure to change the name, but owner Dan Snyder has refused. In the bands case, a divided federal appeals court in Washington, D.C., struck down a portion of the 70-year-old federal trademark law. The courts majority said the First Amendment protects even hurtful speech that harms members of oft-stigmatized communities. It is a bedrock principle underlying the First Amendment that the government may not penalize private speech merely because it disapproves of the message it conveys, Judge Kimberly Moore said for the majority. In dissent, Judge Alan Lourie said the decision interferes with the governments authority to filter out certain undesirable marks from the federal trademark registration system. He said the ruling would lead to further the degradation of civil discourse. The Obama administration is urging the high court to overturn the ruling. The government says the law simply reflects Congress judgment that the federal government should not affirmatively promote the use of racial slurs and other disparaging terms by granting the benefits of registration. The administration also argues that the law does not restrict speech because the band is still free to use the name even without trademark protection. The American Civil Liberties Union and other groups have supported the Slants and the Redskins in their legal fights. The ACLU says the government cant withhold benefits just because it disagrees with the content of someones speech. The Slants and the Redskins can continue using their preferred names even without trademark protection. But a trademark confers certain legal benefits, including the power to sue competitors that infringe the trademark. For the Redskins, the team could lose millions if it cant block the sale of counterfeit merchandise. The Redskins say they have an even stronger case against the government than the Slants because team has already relied on financial advantages of trademark protection for many years. The team registered six trademarks including the name between 1967 and 1990.The justices will hear arguments in Lee v. Tam, 15-1293, early next year.Other new cases the justices agreed to take up on Thursday include:-a dispute over the minimum standards that public schools must meet to help learning-disabled students-whether state laws can prohibit merchants from imposing fees on customers who use credit cards-the Obama administrations appeal of lower court rulings making it harder to deport immigrants whove been convicted of crimes Comprar Jordan Baratas Online .com) - The red-hot Los Angeles Kings will try to extend their winning streak to a season-high seven games when they visit the Edmonton Oilers for Sundays clash at Rexall Place. The 20-year-old Pelicans big man glanced up and smiled widely at the well-wishers -- a fitting end to a day he wont soon forget. No. 20 Navy and its high-powered triple option attack will face a huge test against visiting Temple in the American Athletic Conference championship game on Saturday (Noon ET, ABC).The Midshipmen (9-2, 7-1), who won the West Division of the AAC, are playing for a conference title for the first time in the 136-year history of their program. Navy, led by quarterback Will Worth, is averaging 342 rushing yards per game, second best in the nation behind New Mexico (360.9).Temple, which won the East Division, advanced to the conference championship for the second consecutive season. The Owls (9-3, 7-1) are riding a six game winning streak and have allowed 273.4 yards per game, ranked third behind Alabama and Michigan. The winner of this game will be in the hunt for the Group of Five bid to a New Years Six bowl. Its a great offense and theyve done a terrific job of wearing teams down and winning the war of attrition, Temple coach Matt Rhule said about the Midshipmen. Thats something we pride ourselves on. Its not often that we play other teams that run, run, run and pound people until they submit, but thats what Navy has done.Worth has put together one of the finest seasons of any Navy football player. He was thrust into the starting role when Tago Smith went down with a season-ending knee injury in the opener against Fordham. From there, Worth has seamlessly run the triple option, managing 2,544 yards of total offense -- 1,181 rushing and 1,363 passing. He has also scored a touchdown in 11 consecutive games, which is the longest active streak in college football.Still, Worths focus has been fully on winning the AAC title, rather than personal stats. Navy spent 134 seasons as an independent before joining the AAC last year. This is exactly where we wanted to be, Worth said. The entire offseason, this is what we worked for. We feel great, just got to keep things rolling right now.Worth will face a tough challenge from an aggressive Temple defense led by defensive linemen Haason Reddick and Praise Martin-Oguike, who have dominated opponents throughout the season. Reddick has registered 211.dddddddddddd5 tackles for a loss, while Oguike has seven sacks. The Owls secondary is equally adept, allowing just 145.8 passing yards per game -- second best in the nation behind only Michigan. It is going to be a tough, hard-nosed football game, Navy coach Ken Niumatalolo said. I dont think any of us expect anything different during a conference championship game.Temple quarterback Phillip Walker has also played a vital role over the teams six-game winning streak. Walker had thrown for 2,700 passing yards, third all-time among Owls quarterbacks for a single season, with 18 touchdowns. He could find some space against a Navy defense that is allowing 264.9 passing yards per game.Walker is complemented by running backs Jahad Thomas and Ryquell Armstead, who have combined for 31 touchdowns this season. The Owls have come a long way since opening the season 1-3. However, they never quit believing in themselves and their confidence is riding high.Nobody believed we were going to win this championship at the beginning of the year, but we did though, Walker said. We lost our first game and then lost our third game and our goal was still right in front of us. We won the east side now, we just have to get prepared for next week.Navy leads the all-time series against Temple, 6-5, including a 31-24 victory in the last meeting at Lincoln Financial Field in 2014.The Midshipmen have one key advantage in hosting the championship game at Navy-Marine Corps Memorial Stadium, where they are tied with Houston for the nations longest active home winning streak. Navy has not lost in Annapolis since a 36-27 setback to Western Kentucky onSept. 27, 2014.Its really exciting for our program to have the championship game here in a venue where weve had a lot of success, Niumatalolo said. Were going to need all our fans to come and cheer and support and be loud for us. Were going to need every edge and advantage we can get. Hopefully, playing at home will be a benefit for us. ' ' '
